At the time of choosing the best surrogate, couples should make sure to check the medical reports and earlier delivery reports of the surrogate before signing up the contract with her. Couples can always take help of an agency to find the right candidate based on specific selection criteria. Couples are suggested to create a questionnaire to discuss with the candidate before selecting them as their Surrogate.

A surrogate mother is a woman who agrees to bear a child for another woman who is incapable to conceive herself. In other words, a surrogate is a substitute mother that conceives, gestates and delivers a baby on behalf of another woman who is consequently to be seen as the real mother of the child. (1)

Finding a Surrogate Mother

People may find a family member or a friend to be a surrogate for them. This greatly reduces the cost of surrogacy. However, everyone is not able to find a woman to volunteer to be a surrogate mother for him or her. In such conditions, most people find a surrogate through agencies. (2)

What do surrogate agencies do?

Agencies are very helpful and make sure that surrogates are selected on the basis of psychological evaluations and other medical tests to ensure the best chance of healthy and successful deliveries. They also solve all legal matters concerning the two parties. (3) There are many surrogate agencies that will match intended parents to surrogates. When choosing an agency, it is very important to research the history of the agency. Significant questions to ask the agency include how surrogates are screened and their history. It would be better to speak to former clients of the agency. 

Most fertility clinics request that both the intended parents and the surrogate undergo a psychological evaluation prior to entering into a surrogacy agreement. (4) Intended parents seeking surrogacy through assisted reproductive technology (ART), and the surrogate, both shall enter into a surrogacy agreement, which shall be legally enforceable. (5)

A set of questions that intended parents should ask:

1. What questions one should ask to the surrogate agency?

  • Is the agency responsive to clients or not? Are they prompt in returning calls and e-mails?
  • Is there more than one person who can respond if the primary contact is not responding or busy?
  • Do all the members of the firm operate as a team? (6)

2. What questions should be asked to the surrogate mother?

  • Do they meet the surrogate in person before selection?
  • Does the agency evaluate the home environment of the surrogate or the screening is limited solely to a telephone call or interview in office?
  • Do they perform reference checks? (6)

Some intended parents choose to search for a surrogate without any help. In this case, it becomes important that both intended parents and potential surrogates obtain legal advice before making any agreements or signing any contracts. A clear contract is very useful in preventing many potential conflicts during the process. Intended parents should also research the history of the potential surrogate to make sure that there is no cause for concern.

What are the qualities of a surrogate mother?

There are some qualities that the surrogacy agency and the intended parents expect from a surrogate mother. We have listed some of the qualities here:

  • A surrogate should be in good physical and mental health
  • She should have carried and delivered at least one baby
  • She should have had pregnancies that were all free of complications and were full-term
  • The surrogate should be less than 43 years of age. Some clinics also accept an older woman in certain conditions while others have younger age cut-offs for surrogates mothers
  • She should be in a stable living situation
  • She should not smoke or abuse alcohol (7)
