    4.  What are the surrogacy laws in Georgia?

    The first thing you should know that there are no surrogacy laws in Georgia that specifically address the legality of this process. Despite the fact that Georgia does not have well-defined surrogacy laws, the state follows the safe and efficient legal process for surrogacy. According to Article 143 of the Law of Georgia “On Health”, in vitro fertilization or surrogacy shall be allowed: 

    • If a woman does not have a uterus to carry a baby or 
    • If there is a risk of transmitting a genetic disease from the wife or the husband to the child. (6) 

    In Article 144, it is stated that it is possible to use female and male sex cells or an embryo conserved by the method of freezing during ART procedures. (7) In case of embryo donation, Statute § 19-8-41 in Georgia defines the intended parents have the legal right on the child born from a surrogate mother and no one else including the egg donor or sperm donor will have any right on it. Georgian law allows couples married couples to undergo surrogacy in Georgia without any age limit. (8) It is, however important that you work in coordination with experienced surrogacy professionals to have a smooth journey and have your rights reserves throughout the process. As long as the surrogacy contracts have proper legal documentation and are created in good faith, the Georgian court will see it as legal contracts. 

    5.  How does surrogacy work in Georgia?

    Surrogacy laws and process in Georgia follows similar surrogacy procedures just like any other country in the world. Although every surrogacy is different certain common steps always remain the same in the arrangement:

    • Consultation Meeting: In this session, the applicant receives broad and comprehensive information on the different stages of the surrogacy program.
       
    • Signing Contract with the Centre: The intended parents signs an agreement with the centre and deposit the money in a trust account on the applicant's name, which is managed by the appointed lawyer. (6)
       
    • Finding a surrogate: One can find a surrogate mother in a preferable way, which could mean either through friends or family or with the help of a surrogacy program or agency. Based on the center's experience and knowledge, the center will help you to select the most suitable surrogate for you.
       
    • Screening: Both the parties need to pass screening tests to get approval from a medical and mental health professional to be deemed fit for surrogacy. 
       
    • Surrogacy Contract: A legal contract illustrating the responsibilities, expectations, liabilities, cost and risks of surrogacy process will be made to clear the overview of the surrogacy process. 
       
    • Embryo Preparation and Transfer: After signing up the agreements and the screening process, the clinical stage is starting; embryo preparation may be done in your country. Clients can select the embryologist who will be responsible for the embryo preparation. The applicant can retrieve her oocytes in a clinic in Georgia if she wishes to or she can retrieve her oocyte in her home country and ship them to Georgia. If egg donation is required, the center will assist the applicant in selecting from a Georgian donor. The couple's embryos will be shipped by the center to the surrogacy clinic in Georgia for the transfer to the surrogate womb. If pregnancy is not achieved after three attempts the surrogate mother will be replaced in order to increase the success rate and assure pregnancy.
       
    • Pregnancy and Birth: During pregnancy, the surrogate will undergo a wide range of checkups, hormonal screening, mid-range ultrasound, and amniotic fluid, all in accordance with the couple's request. Once the surrogate is declared pregnant and the pregnancy is considered a healthy one, a pre-birth is obtained in the last phases of pregnancy to establish parental rights for the intended parents. During the pregnancy period, the surrogate will be accompanied by a representative of the center who will visit her at home and go with her for the remaining following treatments.
       
    • Legal Status of the Child: The center will take care of the legal procedures involved in completing and issuing the birth certificate of the newborn child.

    6.  Do surrogacy laws in Georgia allow a pre-birth order according to the choice of the surrogate mother if none of the parties belong to Georgia?

    Yes. A pre-birth order can be obtained in Georgia to obtain legal recognition of the intended parents as the legal parents. A pre-birth order is a legal document assigning parentage to a child and is generally done when none of the parties are from Georgia.

    7.  Are both the intended parents considered to be the legal parents as per a pre birth order if any one of them being genetically related to the baby?

    8.  What is the procedure to get a birth certificate post delivery?

    In the Republic of Georgia, the House of Justice issues the birth certificates of babies born from gestational surrogacy. The intended parents are asked to visit the A. House of Justice within 48 hours after their baby’s birth. You can expect around two weeks time or one week if expedited to get a birth certificate. To avoid complex legal issues and strict court process, it is compulsory to apply for the birth certificate within seven days of delivery.

Countries, which require the name of the surrogate to be individually noted on the birth certificate, are not eligible for surrogacy in the Republic of Georgia because only the names of the intended parents appear on the birth certificate and surrogates are not mentioned. The time taken to get travel documents for a child born with the help of surrogacy to foreign nationals is different for different countries. Accordingly, the Legislation of Georgia regulates the birth registration rules of the child born as a result of In vitro Fertilization.

    10.  Do foreign nationals have to be physically present in Georgia to sign surrogacy contracts?

    As per the surrogacy laws in Georgia, foreign nationals do not have to be there physically in Georgia to sign surrogacy contracts. If the intended parents are not in the Republic of Georgia at the time of their baby’s delivery, they must arrange a power of attorney in Georgia to a local agency so that they can apply for the birth certificate on behalf of the intended parents. Intended parents can also grant Power of Authority that enables surrogacy agency staff to sign the contract on their behalf. There are still a number of moral and ethical issues regarding surrogacy that needs to be addressed. The need for clear guidelines is identified, particularly concerning the eligibility of intended parents age limitations, the standard process of surrogacy and so on.
