Medically Reviewed by Dr. Deepika Tiwari - MS, MBBS on 16 May 2019 - Written by Dr. Neo Ban Leong Ben - MRCOG, M MED, MBchB - Grammatically Approved by Dr. Kavita Jaggi Agrawal - MS, MBBS

Best surrogacy doctors in Greece with High Success Rates include the names such as Dr. John Giakoumakis, Dr. Ioannis Koutoulakis, and Dr. Nikos Prapas. Surrogacy doctors in Greece are based on surrogacy cost in Greece, treatment and medical facilities availability, doctors experience, affordability, and success rates.

Best surrogacy doctors in Greece assist intended parents in evaluating their fertility problems and offer fertility treatments. This includes everything from preparing the intended mother for egg retrieval, syncing up her cycle with the surrogate in order to obtain a successful embryo transfer. Surrogacy is a procedure where both of the intended parents may or may not have a genetic connection to the child. This usually happens in Altruistic type of Surrogacy. It is one of the Assisted Reproductive Techniques, which has evolved to a great extent over the years. The commissioning mother’s eggs are fertilized with the intended father’s sperms in the medical laboratory popularly known as embryology lab. The resulting embryo(s) are then transferred in the surrogate’s womb. In this case, the surrogate’s role is simply that of a “gestational carrier”. The most popular form of surrogacy is the gestational type, or IVF surrogacy wherein, an embryo from the intended parents, or from a donated egg or sperm, is implanted into the surrogate’s uterus. (1) In gestational surrogacy, the woman (gestational carrier) who carries and delivers the child has no genetic relationship with the child born with the procedure. The altruistic gestational surrogacy arrangements were made legal in Greece since 2002 following special permission of the court.

In this article we will learn about:

    1. Surrogacy in Greece:

In Greece, the surrogacy legislation is clear and unambiguous for surrogacy arrangements in the country. Greece so far is one of the very few jurisdictions in the European Union and worldwide, where surrogacy arrangements and contracts have been successfully adopted. It allows childless couples from across the world to conceive children through surrogacy. It also sets the legal framework within which the process can be carried out, unlike other jurisdictions where the laws are either unclear or specifically prohibits surrogacy. Surrogacy is a one-way street for women who cannot conceive or carry a baby in her womb for several health reasons. It mostly concerns women who have undergone chemotherapy, radiation therapy, and hysterectomy or suffer from chronic diseases (e.g. heart disease, kidney failure, etc.). It is also an option for women who are at an increased risk of miscarriage or history of multiple miscarriages; women who suffer from congenital uterine absence, disorders of the uterus or multiple fibroids.

    Surrogacy in Greece

Surrogacy doctors in Greece provide extensive surrogacy-related services and treatments. The latter covers all potential aspects of surrogacy arrangements, including the emotional and psychological impact on both intended parents and surrogate mother. They also take account for all the medical tests recommended for surrogate mothers and advise for the most suitable artificial insemination method, always in compliance with the prevailing legal framework in force. The surrogacy centres follow a typical procedure for issuing the birth certificate and follow other medical and legal procedures required in surrogacy. The surrogacy centres in Greece have set certain rules for both the commissioning parents and the surrogate. Some of these rules are explained below.

    Specific Rules for Surrogate:

    • The surrogate should be medically and mentally fit
    • In case that the surrogate mother is married, her spouse should also submit his acceptance in written by signing the agreement that he is fine with the clauses in the contract.
    • The fertilized ova should not belong to the surrogate mother
    • Surrogate should submit a written agreement between herself and the intended parents to the court.

    Rules for the Intended Parents:

    • The intended mother should not exceed the age of 50
    • Male partner (intended father) should also agree to the surrogacy agreement
    • The intended mother should medically prove that she is unable to carry the child to term

    2. Surrogacy Laws in Greece:

Surrogacy laws in Greece are pretty flexible and different from other jurisdictions. Except for Altruistic surrogacy, all other kinds of surrogacy arrangements are prohibited in the country. The laws in surrogacy have explicitly banned Traditional, Commercial and Social types of Surrogacy, while implicitly prohibiting Gay Surrogacy. Surrogacy law in Greece is regulated by Article 1458 of the Greek Civil Code introduced with article 8 of the Law 3089/2002.
Surrogacy laws in Greece permit the procedure on the following basis:

    • The surrogate mother is not genetically related to the child
    • The intended mother should be able to prove that she is unable to carry the child to term (and she cannot be over 50 years old)
    • The surrogate should be able to prove to the court that she is medically and mentally fit to gestate the baby
    • The surrogate's partner (if any) should consent to her acting as a surrogate
    • Both the couple (or single woman or couple in partnership with signed notary deed) and surrogate have to reside in Greece (Law 4272 (11.07.2014), paragraph 17)
    • Surrogacy contracts are recognized for legal purposes, and parental rights are awarded to the commissioning parents after the birth of the baby.

    Surrogacy law in Greece

All of these strict regulations were set up to protect the rights of the parties involved, including child, surrogate, and commissioning parents. (2) According to surrogacy laws in Greece and other related minor regulations, surrogacy is only allowed after a judicial decision is issued by the district court where the intended parents and the surrogate reside. The intended parents should apply to the court and the insemination procedure can only take place after the publication of the judicial decision. (3)

    3. Fertility Market in Greece:

The fertility rate for a particular year can be defined as the total number of babies that would be born to each female. This is considered in case if she were to live to the end of her child-bearing years and give birth to children lining up with the country’s prevailing age-specific fertility rates. The total fertility rate of a particular country is measured by summing up the age-specific fertility rates as explained over an interval of five years. Estimating no net migration and unchanged mortality rate, a total fertility rate of 2.1 children per woman determines a stabilized population in a country. (4) The fertility rate statistics of 2017 showed that the total fertility rate in Greece was 1.43 children born per woman. (5)

In 2018, the fertility rate for Greece stood at 1.3 children per woman. Over the last 4 years, the fertility rate of Greece is decreasing at a moderating rate to shrink from 1.31 children per woman in the year 2015 to 1.3 children per woman for the year 2018. In the year 2015, the number of births (both genders combined) for Greece stood at 509.15 thousand. Though the number of births in Greece witnessed fluctuations substantially in recent years, it tended to decline through 1970 - 2015 period ending at 509.15 thousand in 2015. The age of childbearing for Greece in the same year was 30.74 years. Age of childbearing of Greece witnessed an upward slope from 27.8 years in 1970 to 30.74 years in 2015 increasing at an average annual rate of 1.15 percent. (6)

There are several reasons for the significant decrease in birth rates in recent times include factors such as delayed family formation and child-bearing and decline in desired family sizes. The structure of Greek society and family is changing notably owing to the declining fertility rate in the Mediterranean country. A report in the Greek National Center for Social Research revealed that the fertility rate in Greece declined to 1.1 from 1.3 and the number of live births in the Mediterranean country also witnessed a drastic decline since 2009. A fertility rate measuring to at least 2.0 is considered important for a stable population. (7)

They are always involved in the initial consultation and performing transvaginal scanning of patients. The nursing staff at the surrogacy centres in Greece understands the basics of endocrinology, gynecology, embryology, andrology, obstetrics, and genetics.
